Terms of Service

These terms govern your use of www.exploreunexplored.in and any tour, trip, or program you book with Explore Unexplored. By booking with us or using our site, you agree to them. Please read alongside our Cancellation Policy and Privacy Policy, which form part of this agreement.

1. Who we are

Explore Unexplored organizes and operates group tours, trekking trips, and customized itineraries across India, and coordinates third-party hotels, transport, guides, and permit providers on your behalf. For most bookings, we act as a tour operator delivering the trip directly with our own Trip Captains; for some inclusions (flights, certain permits, specialist activities), we act as an agent connecting you with an independent third-party supplier, who is responsible for that specific service.

2. Booking & payment

• A booking is confirmed only once we've received the specified deposit for your chosen tour and batch.
• The balance amount is due before departure, on the timeline our team communicates at the time of booking.
• Prices are per person, based on the sharing/occupancy stated for that tour, and may change until a deposit is paid and your seat is confirmed.
• Seats are allocated on a first-confirmed, first-served basis and are subject to a batch reaching its minimum group size.
• All prices are in Indian Rupees (INR) unless stated otherwise, and exclude anything explicitly listed under a tour's exclusions.

3. Your responsibilities as a traveler

• Carry a valid government-issued photo ID (and passport/visa, where the itinerary requires it) for the entire trip.
• Disclose any medical condition, mobility limitation, or dietary requirement that could affect your participation in a trek or activity, before booking.
• Arrive at the stated reporting point and time — we can't guarantee to wait for late arrivals without affecting the group's schedule.
• Behave respectfully toward fellow travelers, local communities, and the environments we visit.
• Arrange your own travel insurance — strongly recommended for all trips, and particularly for trekking and high-altitude itineraries.

We reserve the right to remove a traveler from a trip, without refund, if their conduct endangers themselves, other travelers, or the trip's local partners.

4. Changes to itineraries

Itineraries are planned in good faith but travel in India — especially in mountain and remote regions — is subject to change. We reserve the right to modify the order of sightseeing, accommodation, or transport arrangements due to weather, road conditions, local events, or vendor availability, while keeping the overall trip experience as close to advertised as possible. Where a change materially reduces the trip's value, we'll discuss options with you, including a partial refund where appropriate.

6. Limitation of liability

• We are not liable for delay, loss, injury, or damage caused by circumstances beyond our reasonable control — natural disasters, landslides, extreme weather, strikes, government action, or similar force majeure events.
• Where a third-party supplier (airline, hotel, transport operator) is responsible for a service, our liability is limited to making reasonable efforts to help resolve the issue on your behalf — the supplier's own terms and liability limits apply to that service.
• Adventure and trekking activities carry inherent risk. You participate at your own risk and are responsible for assessing your own fitness for an itinerary before booking.
• Nothing in these terms limits liability that cannot be excluded under Indian law, including liability for death or personal injury caused by our negligence.

7. Images, itineraries & content

All text, photography, itinerary designs, and branding on this site belong to Explore Unexplored or are used under license, and may not be copied or reproduced for commercial use without our written permission. Photos you share with us from a trip (e.g. through a review or social media tag) may be used in our marketing, with credit where reasonably possible — let us know if you'd prefer we didn't.

8. Governing law & jurisdiction

These terms are governed by the laws of India. Any dispute arising from a booking or use of this site will first be addressed through good-faith discussion with our team; if unresolved, it will be subject to the exclusive jurisdiction of the courts of Goa, India.

9. Changes to these terms

We may update these terms from time to time to reflect changes in our services or the law. The version in force at the time you make a booking is the one that applies to that booking.
